TSE ratifies JCE resolution on the distribution of funds to political parties

The Superior Electoral Court (TSE) has issued a key ruling by rejecting the request for a precautionary measure filed by the Proyecto Visión Nación (PVN) and José Cristopher Ramírez. The legal action sought to temporarily halt the application of Resolution 01-2026 of the Central Electoral Board (JCE), which regulates the distribution of state economic resources allocated to political organizations for the current year.

Judicial decision details

The electoral court magistrates determined that the request did not meet the fundamental criteria established in article 160 of the Regulations for Electoral Contentious Procedures. According to the court’s analysis, the plaintiffs failed to demonstrate the existence of an “imminent harm” that was irreparable, nor the appearance of a good right necessary to suspend an administrative provision of such magnitude.

The court concluded that, although the application met the formal requirements, the substantive arguments presented by the plaintiffs were not sufficient to justify a suspensive measure against the JCE’s resolution.

The judges noted that the electoral entity did not present conclusive documentary evidence demonstrating that all funds had already been delivered to the parties.

The decision was adopted by the plenary of magistrates composed of Lourdes T. de Jesús Salazar R., Ygnacio Pascual Camacho Hidalgo, Pedro Pablo Yermenos Forastieri, Fernando Fernández Cruz, Rafaelina Peralta Arias, and Lenis Rosángela García Guzmán. As part of the protocol, the court has ordered formal notification to the parties involved and the publication of the ruling on its institutional portal, maintaining the regulations of the Central Electoral Board for this year’s budgetary exercise.
