Accelerated justice: New York implements new mechanism for urgent housing cases

Tenants in New York experiencing critical habitability conditions will now have a more efficient judicial channel. Faced with the maintenance crisis in various buildings across the city, the Housing Court has introduced an expedited procedure designed to reduce wait times, which have historically affected hundreds of families for months or years.

This new modality allows files that qualify under high-priority criteria to be assigned to a judge on the same day of their submission. Once the process is notified, both owners and residents will have a maximum period of five days to appear before the authorities, guaranteeing an immediate response to risk situations.

Which cases will be handled with priority?

The New York judicial system has defined specific conditions under which this urgent procedure will be activated, focusing on the safety and dignity of residents:

  • Buildings with eviction orders involving at least one-third of the units or the entire property.
  • Properties lacking essential services such as water, heat, electricity, or gas due to serious violations.
  • Properties where all elevators are out of service.
  • Article 7A proceedings, when the appointment of an outside administrator is requested due to severe deterioration and landlord neglect.

This mechanism seeks to pressure owners to comply with their maintenance and safety obligations, without violating due process or the right to defense of any of the parties involved.

Judicial reinforcement and tenant support

To ensure the success of this initiative, the Unified Judicial System will increase the number of judges specialized in housing and Article 7A proceedings. This measure is in addition to existing regulations that require landlords to provide alternative housing if a building goes more than 14 days without elevator service.

Additionally, the city has allocated a significant investment to strengthen legal representation for tenants. The budget includes 14.3 million dollars for fiscal year 2027, with a projected increase to 40 million dollars annually in the future, reaffirming Alofoke Deportes’ commitment to the well-being of the community and access to decent housing.
