Salvadoran justice system hands down first life imprisonment sentence in the country’s history
In an unprecedented event for the judicial system of El Salvador, the Third Criminal Court of San Salvador, based in Santa Tecla, has handed down the first life imprisonment sentence. This measure is supported by recent constitutional and penal reforms that allow for the application of this maximum penalty to crimes of extreme gravity.
The sentenced individual is Carlos Arturo Herrera Castro, 31, who was declared responsible for the crimes of aggravated homicide and robbery to the detriment of Alexis López Córdova. Both the Attorney General’s Office and the Judicial Centers confirmed that this ruling marks a milestone in the application of the new Salvadoran penal regulations.
Crime details
The incident occurred on May 18, 2026, in the Teosinte canton, located in the district of Arcatao, Chalatenango. According to the investigations presented by the Public Prosecutor’s Office, the aggressor and the victim had a prior relationship. After an argument fueled by the consumption of alcoholic beverages, Herrera Castro attacked López Córdova using stones, causing fatal injuries.
The Prosecutor’s Office managed to prove that, after committing the homicide, the convicted person proceeded to steal the cash that the victim was carrying. Among the evidence presented during the trial, the following points stood out:
- The testimony of a person who observed the accused counting the stolen money at the crime scene.
- The attempted bribery by the aggressor, who offered 10 dollars to a witness so they would not report the events to the authorities.
The court found Herrera Castro guilty of aggravated homicide and robbery, based on the body of evidence that demonstrated the primary intent of the attack was to seize the victim’s belongings.
Scope of the new regulations
The imposition of this sentence was possible thanks to the reforms to Article 27 of the Constitution and other penal provisions that entered into force on April 26, 2026. This legislation empowers courts to punish crimes such as homicide, femicide, rape, and participation in terrorist organizations with life imprisonment.
Although the sentence is perpetual in nature, Salvadoran law contemplates review mechanisms under specific conditions:
- For adults sentenced for a single crime, the first review may be requested after serving 30 years in prison.
- In cases of concurrent crimes, the period for review is extended to 35 years.
- For sentences with aggravating factors, the review is enabled after 40 years of imprisonment.
With this resolution, the judicial system reaffirms its capacity to apply new legal tools to combat serious crime in the national territory.
