Constitutional Court ratifies País Posible’s position on the electoral ballot
The Constitutional Court of the Dominican Republic has issued a final ruling that puts an end to the dispute over funding and ballot positioning ahead of the 2028 elections. Through Judgment TC/0746/26, the high court dismissed the motion for review filed by the parties Social Justice (JS), National Unity (PUN), and Democratic Option (OD), thereby ratifying the previous ruling of the Superior Electoral Court (TSE).
Decision details
With this resolution, it is confirmed that the Central Electoral Board (JCE) will maintain intact the economic allocation and the numerical order assigned to País Posible, an organization led by Milton Morrison. Under this criterion, the party consolidates itself as the seventh political force of the Dominican electoral system.
The legal conflict originated in March 2025, when País Posible challenged the JCE resolutions that determined the categorization of parties based solely on the most favorable electoral level from the May elections. The organization argued that this method limited the true representation of citizen support.
The electoral interpretation criterion
The TSE, by accepting the position of País Posible in June 2025, ruled that the evaluation of political strength must be carried out considering the complete electoral cycle, adding the valid votes obtained in the seven levels of election. This criterion was supported by the Constitutional Court, whose magistrates determined that the TSE’s interpretation respected the constitutional principles of:

Legal impact
The ruling not only resolves the particular case, but also establishes a relevant precedent regarding the limits of diffuse control of constitutionality.
