Nicaragua challenges Germany before the International Court of Justice over the conflict in Gaza
In a key hearing before the International Court of Justice (ICJ) in The Hague, Nicaragua has sharply questioned Germany’s stance regarding its historical responsibility toward Israel. The Nicaraguan delegation argues that such a moral imperative, born from the atrocities committed during the Nazi regime, should compel Berlin to make tangible efforts to prevent similar crimes against the Palestinian people.
Ambassador Carlos José Argüello Gómez, representative of Nicaragua, acknowledged the importance of the German commitment following the crimes against humanity perpetrated in the past. However, he emphasized that this legacy cannot be used as a justification to omit current international obligations in the face of the humanitarian crisis in Gaza.
The core of the legal dispute
The litigation, initiated by Managua in 2024, maintains that the political and military support provided by Germany to Israel contravenes the Genocide Convention and international humanitarian law. For its part, the German defense maintains that its support is a response to its historical responsibility for Israel’s security, underlining that this does not imply a violation of international norms.
Currently, the ICJ is evaluating the objections presented by Germany regarding the court’s jurisdiction, before proceeding to analyze the merits of the accusations presented by Nicaragua.
The genocide is being carried out in Gaza publicly and broadcast live. Germany has not only never stopped exporting military equipment to Israel, but has also opposed international measures against the Israeli government.
