Superior Electoral Court ratifies JCE resolution on the distribution of party funds

The Superior Electoral Court (TSE) has issued a key ruling by dismissing the request for a precautionary measure filed by the Visión Nación Project (PVN) and José Cristopher Ramírez. The plaintiff sought to halt the application of Resolution 01-2026, issued by the Central Electoral Board (JCE), which establishes the criteria for the distribution of state economic resources allocated to political parties, groups, and movements for the current year.

Judicial decision details

After analyzing the file, the magistrates determined that the petition did not meet the necessary legal requirements to proceed with a provisional suspension, in accordance with the provisions of Article 160 of the Regulations for Contentious Electoral Procedures. The court emphasized that, in order to grant a measure of this nature, it is essential to demonstrate the appearance of good law and the existence of imminent and irreparable harm, elements that were not satisfactorily proven by the plaintiffs.

The magistrates concluded that, although the request met the formal requirements for admissibility, the arguments presented by the plaintiff lacked the necessary strength to justify the suspension of an administrative measure by the JCE.

  • Procedural legitimacy: The TSE rejected the JCE’s argument questioning the legitimacy of the PVN. The judges clarified that, as there is a main proceeding (file TSE-01-0021-2026), the plaintiffs have the required procedural standing.
  • Regarding the subject of the request: The court dismissed the Board’s position, which alleged that the case lacked a subject due to an alleged total execution of payments. The magistrates pointed out that the electoral entity did not present sufficient documentary evidence to confirm the total delivery of funds to the political organizations.

The ruling was adopted by the plenary of judges of the TSE, composed of Lourdes T. de Jesús Salazar R., Ygnacio Pascual Camacho Hidalgo, Pedro Pablo Yermenos Forastieri, Fernando Fernández Cruz, Rafaelina Peralta Arias, and Lenis Rosángela García Guzmán. Finally, the court ordered formal notification to the involved parties and the publication of the ruling on its institutional portal for transparency purposes.
