Plastic surgeon José del Carmen Desena Montero, who was sentenced in 2025 for involuntary manslaughter following the death of a patient during an aesthetic procedure, has regained his freedom. This resolution came after the justice system overturned the arrest warrant that had been issued against him once again.

Judicial process details

The release of the physician was made possible thanks to a decision by the Third Chamber of the Criminal Court of Appeals, which annulled the resolution that served as the basis for his detention. Previously, the doctor had been deprived of his liberty on September 18, 2026, on the grounds of an alleged breach of the conditions of his suspended sentence.

Following the ruling of the higher court, the Sentence Execution Court of the National District acted accordingly, allowing the surgeon to leave the facility where he was being held.
