New Penal Code: The challenge that transforms the work of appellate judges in the Dominican Republic

Magistrate Doris Josefina Pujols Ortiz highlighted that the implementation of the new Dominican Penal Code marks a turning point for the judicial system, especially for appellate judges. According to the judge, this legal framework requires greater depth in legal analysis and a more direct responsibility when issuing definitive rulings.

During his recent appearance before the National Council of the Magistracy (CNM), within the framework of the evaluation process to join the Supreme Court of Justice, Pujols detailed that the current regulations alter the traditional dynamic with which second-instance courts managed case files.

This new code brought with it a modification that eliminates the referral to a new trial, which means that we, as appellate judges, are obligated to issue our own ruling, for which we must perform an exercise of evaluation and weighting of both the facts and the evidence.

Greater procedural rigor

The magistrate emphasized that the legislative change has forced judges to step out of their comfort zone. By eliminating the possibility of remanding certain cases for a new trial, the system now demands that appellate courts assume the comprehensive assessment of the evidence and facts presented.
