NASCAR Seeks to Mediate Antitrust Lawsuit with 23XI Racing and Front Row Motorsports

In a recent move, NASCAR has requested a judicial conference from a federal court for the resolution of the antitrust case filed by 23XI Racing, owned by Michael Jordan, and Front Row Motorsports. NASCAR’s request seeks an independent judge to mediate the legal dispute. However, the 23XI Racing and Front Row Motorsports teams have responded, showing their preference for continuing negotiations with the current mediator, Jeffrey Mishkin.

Mr. Mishkin has invested a great deal of time learning about this case and meeting with the parties.

The teams argue that Mishkin possesses vast experience in antitrust disputes related to sports and has acted as an arbitrator or mediator in major sports organizations. The motions found arise as NASCAR seeks summary judgment to dismiss the case before the start of the trial scheduled for December 1. A hearing on this motion is scheduled for October 21. The conflict centers on the protection of NASCAR’s franchise system, known as the charter system, which is fundamental to its business model. A year ago, 13 of the 15 teams renewed their agreements, but 23XI Racing and Front Row Motorsports chose to take the matter to court. For months, other teams have expressed concern about the uncertainty generated by the demand. Given the lack of progress in negotiations with Mishkin, NASCAR seeks the intervention of a federal judge to facilitate the resolution. NASCAR hopes a court conference can help direct the conversations and offer a perspective on how a jury might interpret the complex antitrust case. All parties involved, including Michael Jordan, have expressed their willingness to reach an agreement.
