{"id":78321,"date":"2025-11-15T05:29:49","date_gmt":"2025-11-15T09:29:49","guid":{"rendered":"https:\/\/alofokedeportes.com\/en\/sin-categoria\/nascar-counterclaim-dismissed-in-antitrust-case-against-23xi-racing-and-frm\/"},"modified":"2025-11-15T05:29:49","modified_gmt":"2025-11-15T09:29:49","slug":"nascar-counterclaim-dismissed-in-antitrust-case-against-23xi-racing-and-frm","status":"publish","type":"post","link":"https:\/\/alofokedeportes.com\/en\/nascar\/nascar-counterclaim-dismissed-in-antitrust-case-against-23xi-racing-and-frm\/","title":{"rendered":"NASCAR: Counterclaim dismissed in antitrust case against 23XI Racing and FRM"},"content":{"rendered":"<h2>Federal Judge Dismisses NASCAR&#8217;s Claim Against Suing Teams<\/h2>\n\nA federal judge ruled in favor of 23XI Racing and Front Row Motorsports, dismissing NASCAR&#8217;s counterclaim in a legal dispute over allegations of anti-competitive practices.\n\nU.S. District Judge Kenneth Bell issued a summary judgment in favor of 23XI Racing and Front Row Motorsports, rejecting NASCAR&#8217;s claim that Curtis Polk, co-owner of 23XI, illegally conspired with other teams during negotiations for new bylaws.\n\n23XI is owned, among others, by Michael Jordan, NBA Hall of Famer, and Denny Hamlin, three-time Daytona 500 winner. Polk, in turn, has been Jordan&#8217;s longtime business manager. Polk was also part of a four-member negotiating team that worked with NASCAR for more than two years on the charter agreement signed by 13 of the 15 organizations last year.\n\nNASCAR argued in its counterclaim that a 2023 boycott of the meeting of the team owners council negatively impacted media rights negotiations, and that, by the 15 organizations joining for the charter talks, the teams obtained a better deal than they would have gotten if NASCAR had negotiated separately with them.\n\nBell determined that the boycott was a negotiation tactic &#8220;that seemed to have little impact&#8221; because NASCAR began individual negotiations shortly thereafter.\n\nBell also found that 23XI and FRM did not engage in an &#8220;unreasonable restraint of trade&#8221; because NASCAR&#8217;s individual meetings with the teams did result in some changes to the charter agreement, and since all charter agreements would be the same among all teams, that the teams working together in negotiations would be reasonable.\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n\n<p>&#8220;The evidence here establishes that not only were individual negotiations &#8216;available,&#8217; but NASCAR had such negotiations regularly during the negotiation period,&#8221; Bell wrote in his order. &#8220;And those individual negotiations achieved concrete results, including the final 2025 charter agreement that was signed by 13 teams acting individually (and contrary to the supposed &#8216;joint agreement&#8217;)&#8221;.<\/p>\n\n<cite>Kenneth Bell, United States District Judge<\/cite><\/blockquote>\n\n\nBell must also rule on two other summary judgment motions, one from NASCAR seeking a ruling in its favor and another from 23XI and FRM to designate the market as &#8220;premier stock-car racing.&#8221;\n\nTwo days of mediation last week failed to end this dispute and the case is still scheduled for a trial date of December 1 in North Carolina.\n\n23XI and FRM are the only two organizations out of 15 that refused to sign charter extensions, which are the core of NASCAR&#8217;s business model. A car with a charter is guaranteed income and access to weekly races, and without them both teams say they would almost certainly go bankrupt.\n\n\u201cToday\u2019s decision has only reaffirmed my clients\u2019 unwavering pursuit of a fairer and more equitable sport,\u201d said Jeffrey Kessler, attorney for 23XI\/FRM, in a statement. \u201cTheir determination remains strong as we continue our efforts to achieve a resolution that benefits everyone: teams, drivers, employees, partners, and fans.\u201d\n\nNASCAR indicated in its statement that it still hopes to reach an agreement.
