This Tuesday, Clancy appeared in court again at a key hearing intended to define the legal direction of this complex process, after her trial was declared a mistrial at the beginning of September.<\/p>\n\n<p>The tragedy, which shocked the community of Duxbury, Massachusetts, occurred when 5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan were found lifeless after having been strangled. Clancy, who attempted to take her own life following the events, leaving her partially paralyzed, faces murder charges, although her defense maintains a plea of not guilty based on a critical mental health state.<\/p>\n\n<h3 class=\"wp-block-heading\">The defense strategy<\/h3>\n\n<p>The defendant&#8217;s legal team, led by attorney Kevin Reddington, has filed a formal motion with Judge William Sullivan to dismiss the current charges. The defense argues that the prosecution has failed to consolidate the necessary evidence to support a conviction. Furthermore, the legal team seeks to delve deeper into the irregularities noted during the first trial:<\/p>\n\n\n<ul class=\"wp-block-list\"><li>The trial was declared a mistrial on September 4th due to the jury&#8217;s inability to reach a unanimous verdict.<\/li><li>The defense alleged that a juror, identified as Michael Desronvil, acted against deliberation instructions, being the only one to vote for Clancy&#8217;s guilt.<\/li><li>The lawyers are requesting an investigation into said juror&#8217;s history and access to court documents related to a previous abuse lawsuit involving Desronvil.<\/li><\/ul>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>The defendant maintains that she is not criminally responsible for the acts because, at that time, she was suffering from a severe psychotic episode derived from deep postpartum depression.<\/p><\/blockquote>\n\n\n<p>Currently, Lindsay Clancy remains admitted to a psychiatric facility while the judicial system evaluates the next steps.
