Magistrate F. Dennis Saylor IV described the justification presented by the Executive branch to apply these changes to F, J, and I visa categories as extremely weak.

The measure, which sought to limit the stay of students to a maximum of four years and drastically restrict the stay of foreign journalists—establishing limits of 240 days for most and just 90 days for those with a Chinese passport—has been questioned for its lack of administrative rigor. According to the ruling, the regulation did not comply with the required legal procedures and raises doubts about whether its real objective is national security or excessive control over academic institutions and the press.

The rule raises legitimate questions about whether its true purpose is not to safeguard national security and protect our borders, but to achieve other undeclared objectives, such as exercising greater government control over academic institutions.
F.
