The Plenary of the highest court determined that holders of authorizations for the personal use of this substance are permitted to incorporate cannabis or tetrahydrocannabinol (THC) into prepared or semi-prepared foods, provided that the objective is for private, personal consumption.<\/p>\n\n<p>This resolution establishes that the culinary preparation of cannabis-infused food for personal use should not be considered a manufacturing activity subject to complex sanitary regulations. Thus, the Court clarifies the scope of the permits granted, distinguishing domestic practice from industrial or commercial production.<\/p>\n\n<h2 class=\"wp-block-heading\">Legal restrictions and limits<\/h2>\n\n<p>Despite this openness, the Supreme Court was emphatic in pointing out that this criterion does not open the door to commercialization or distribution. The legal limits remain strict on the following points:<\/p>\n\n\n<ul class=\"wp-block-list\">\n<li>Total prohibition on sale, distribution, or supply to third parties.<\/li>\n<li>Processed products may not be sold to the public.<\/li>\n<li>Restrictions from the Federal Commission for the Protection against Sanitary Risks (Cofepris) remain in place for the creation of medicines, food supplements, cosmetics, vapes, and herbal remedies.<\/li>\n<li>The authorization is personal and non-transferable, limited exclusively to the permit holder.<\/li>\n<\/ul>\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>The judicial decision reinforces the line of criteria initiated in 2015 and consolidated in 2021, which allows adults to carry out activities such as sowing, cultivating, harvesting, and preparing cannabis under a strict self-consumption scheme, without this implying a right to commercialization.<\/p><\/blockquote>\n\n<p>It is important to highlight that, in parallel, Mexico has had a specific regulatory framework since 2021 focused exclusively on the research and medicinal use of pharmacological derivatives of cannabis.
